The High Court has quashed a verdict of unlawful killing into the death of John Hogan’s son.
Liam, who was aged six at the time of incident, died after he fell from a hotel balcony, with his father and sister, in Crete.
John Hogan, from Bradley Stoke, was cleared of murdering Liam by a Greek court in 2008.
But an inquest in the UK reached the unlawful killing verdict which has now been overturned.
The two High Court judges have ruled the case must go back for “further consideration”, and could now the subject of a new inquest.

A Bradley Stoke man who threw his two children off a balcony in Crete, killing one of them, has won the right to appeal an inquest verdict of unlawful killing.
John Hogan was cleared of murdering his son, Liam, by a Greek court earlier this year but an inquest in the UK reached the unlawful killing verdict.
According to the BBC , Lord Justice Dyson and Mr Justice Griffith Williams ruled Mr Hogan’s case raised “serious points that are plainly arguable”.
Mr Hogan will now seek to overturn Avon coroner Paul Forrest’s verdict.

John Hogan, who threw his son to his death from a hotel balcony in Crete, will not face further charges when he returns to the UK.
Mr Hogan, 34, who lived in Bradley Stoke, fell 50ft from a hotel balcony on the holiday island with his daughter Mia and son Liam, who died.
A Greek court cleared Mr Hogan of murder and he is currently in a psychiatric unit in the country.
After the inquest a file was passed to the Crown Prosecution Service but they have ruled there is no “new and compelling evidence”.

John Hogan, whose 50ft jump from a balcony in Crete saw his son Liam die, is to appeal against a coroner’s verdict of unlawful killing.
Hogan, from Bradley Stoke, was cleared by a Greek court of murder will make the appeal to the High Court according to the Evening Post .
The incident, which happened two years ago on the holiday island , also saw his daughter Mia hurt.
Hogan is still being held in a psychiatric unit in Greece but could be released soon and the move is thought to be a bid to avoid a murder trial should he return to the UK.

The inquest into the death of Liam Hogan has returned a verdict of unlawful killing.
Coroner Paul Forrest heard evidence from three witnesses who were not called at the original trial in Crete.
Liam, 6, died when he fell from a balcony at a hotel in Crete in 2006. His sister, Mia, then aged two, and father John survived the fall.
John, from Bradley Stoke, was cleared of an wrongdoing at a trial earlier this year.

The inquest of Liam Hogan got under way at Kingsweston House, Bristol, at 11am.
Natasha Hogan, Liam’s mother, arrived at the court via the back entrance with her mother and step father.
Although three days has been set aside for the case its not thought it will last the allocated time.

11.15am: Coroner Paul Forrest has called for an apology for a statement released by Natasha saying it was trying to influence the inquest. More here .
1.00pm: Evening Post reports John Hogan had “crazed look” before the room fell silent and she realised they had gone over the balcony. There’s also more from the BBC here .
2.00pm: One witness, Sarah Davidson, says she saw a man push Liam and Mia off the balcony but her husband, Iain, claims the man tried to prevent them falling (BBC).
2.20pm: Verdict expected Thursday morning – inquest has now been adjorned for the day.

The inquest into the death of six-year-old Liam Hogan is due to take place in Bristol on Wednesday.
Liam died in Crete in August 2006 when he fell from a hotel balcony with his father, John, and sister Mia, who was then aged two.
Mia and John survived the plunge and John later stood trial for murder but was cleared of any crime earlier this year.
The inquest throws up the possibility of an unlawful killing verdict and will hear from eyewitnesses who were not called at the Greek trial.
